Terms and Conditions for Rivowear

Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the https://rivowear.com website (the “Service”) operated by Rivowear (“us”, “we”, or “our”).
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
1. Our Service
Rivowear provides a simple, convenient service for purchasing premium plain black socks through one-time packs and a recurring subscription model. Orders and subscription management are primarily handled via WhatsApp, phone, or email, with delivery services within Nairobi and other specified areas.
2. Orders and Payments
- Placing an Order: Orders can be placed by contacting us via the WhatsApp, phone, or email details provided on our website. An order is considered confirmed once you have provided your product choice, delivery details, and acknowledged the total price.
- Payment: Payment is due upon confirmation of the order and before delivery. We will provide payment details (e.g., M-PESA Till Number) during the order process.
- Pricing: All prices are listed in Kenyan Shillings (KSh) and are subject to change without notice. The price confirmed at the time of your order is the price you will be charged.
- Right to Refuse: We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in the description or price of the product, or if we suspect fraudulent activity.
3. Subscription Service
- Subscription Plan: Our subscription service consists of a delivery of one (1) 10-pair Starter Pack of socks every six (6) months at the discounted subscription price stated on our website.
- Billing: You will be contacted via WhatsApp or your preferred contact method before each scheduled delivery to arrange payment for the upcoming cycle. Your subscription will only be dispatched after payment is confirmed.
- Management (Pausing and Cancelling): You are in full control of your subscription. You may pause, update your delivery address, or cancel your subscription at any time by contacting us directly via WhatsApp. To avoid being charged for the next cycle, cancellation requests must be received at least 48 hours before your next scheduled delivery notification.
4. Delivery Policy
- Scope: We offer free delivery for all orders within Nairobi. For deliveries outside Nairobi, additional charges may apply and will be communicated to you at the time of order.
- Coordination: We will coordinate a suitable delivery time and date with you via phone or WhatsApp.
- Responsibility: It is your responsibility to provide an accurate delivery address and to be available to receive the package at the agreed-upon time. If a delivery is missed due to incorrect information or your unavailability, a re-delivery fee may be charged. Title and risk of loss for all products pass to you upon our delivery to the carrier.
5. Returns and Refunds Policy
We stand by the quality of our products.
- Eligibility: You may return any unopened and unused product within seven (7) days of delivery for a full refund. To be eligible, the product pack must be in its original, sealed packaging and in the same condition that you received it.
- Process: To initiate a return, please contact us at hello@rivowear.com or via WhatsApp. We will provide instructions on how to return the product.
- Refunds: Once we receive and inspect your returned item, we will notify you of the approval or rejection of your refund. If approved, your refund will be processed, and a credit will be applied via the original method of payment (e.g., M-PESA) within a certain number of days.
Due to hygiene reasons, we cannot accept returns on packs that have been opened.
6. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Rivowear. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Rivowear.
7. Limitation of Liability
In no event shall Rivowear, nor its directors, employees, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
Our total liability to you for any and all claims arising out of or relating to these Terms or your use of our Service or products shall not exceed the amount you paid to us for the product(s) in question.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
9. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
